BY ACCESSING OR USING THIS WEBSITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS WEBSITE.
These Terms and Conditions apply to your use of the McDonald's Arch Card On-Line Reload website and related services ("Services"). The Services are provided by P2W to enable you to reload and add value to your McDonald's Arch Card. "P2W" means P2W, Inc. NFP and its officers, directors and employees. "McDonald's" means, collectively, McDonald's Corporation, its subsidiaries, affiliates, and the officers, directors, and employees of each. "You", "your" and "yours" means the owner of the Account or a person with authority regarding the use of the Services. "We", "our", and "us" means P2W. P2W, a not-for-profit corporation, is the issuer of McDonald's Arch Cards. P2W may revise these terms from time to time. All changes will be effective when they are posted and will apply to your access and use of the Services thereafter.
NOTICE & CONSENT; ELECTRONIC COMMUNICATIONS
By accepting these Terms and Conditions, you agree that P2W may provide in an electronic format all disclosures, notices, communications, terms and conditions and amendments related to the Services.
P2W reserves the right to modify or add to these Terms and Conditions at any time without prior notice ("Updated Terms"). You agree that we may notify you of the Updated Terms by making them available via this website, and that your use of the Services after we have posted the Updated Terms (or engaging in such other conduct as we may reasonably specify) constitutes your agreement to the Updated Terms. Therefore, you should review these Terms and Conditions before using the Services. The Updated Terms will be effective as of the time of posting, or such later date as may be specified in the Updated Terms, and will apply to your use of the Services from that point forward. Updated Terms will apply to your online reloads that begin after the Updated Terms are effective.
When you create your Account, you consent to receiving e-mails from us related to your Account.
P2W may make the Services unavailable to you or other users at any time for any reason, in P2W's sole discretion, without notice or liability. You understand and agree that in the event P2W disables access to your Account or the Services, you may be prevented from accessing the Services, your Account details, or any information or content contained in your Account.
By using the Services, submitting your payment information and or requesting the addition of value to a McDonald's Arch Card, you authorize your financial institution to effectuate payment as you instruct through the Services. You represent that you have all necessary rights, power and authority to authorize each such payment and that you will take such steps as may be required to make such authorization.
McDONALD'S ARCH CARDS
McDonald's Arch Cards are issued by P2W and may be used at any participating McDonald's restaurants in the United States toward the purchase of McDonald's products. Except as otherwise stated in these Terms and Conditions, McDonald's Arch Cards are subject to the terms and conditions printed on the back of the McDonald's Arch Cards.
MOBILE TERMS
If you are choosing to use the Services by using a mobile device, the following additional terms and conditions will apply:
(i) You understand that service may not be available in all areas at all time and may be impacted by the service coverage of your mobile service provider.
(ii) Additional charges assessed by your mobile service provider may apply.
(iii) You are solely responsible for all message and data charges that apply to your use of your mobile device that are billed by your mobile service provider.
BY ACCESSING OR USING THE SERVICES USING YOUR MOBILE DEVICE, YOU AGREE TO BE BOUND BY THESE ADDITIONAL MOBILE TERMS.
ACCOUNT
"Account" and "Accounts" mean the account you establish through this Service.
In creating your Account, you agree to provide and maintain accurate and complete information.
You may only use the Services for lawful purposes and in accordance with these Terms and Conditions. You may not use the Services: (1) for any purpose that is unlawful or prohibited by these Terms and Conditions; (2) to cause harm or damage to any person or entity; (3) to interfere with the operation or functionality of the Services; or (4) to upload, post or transmit any material that violates any law, infringes on the rights of any third party or contains defamatory, libelous, abusive, obscene or otherwise objectionable material (as determined by P2W in its sole discretion).
You are responsible for all activities on or under any Account registered to you and you accept all risks for any unauthorized use of your account.
AUTO (RECURRING) RELOADS
The Services allow you to request a variable or fixed reload dollar amount on a fixed schedule ("Auto Reload"). By establishing an Auto Reload, you authorize P2W to bill your Account on a continued, periodic basis (such as weekly, bi-weekly, monthly, or quarterly) without a specified end date.
You will be able to create, change, or suspend Auto Reload requests from your Account.
RESTRICTIONS ON USE
Arch Card Reloads (including Auto Reloads), whether completed in restaurant or online, will not be refunded and cannot be redeemed for cash (unless required by law).
The maximum value that you can retain on your Arch Card is one hundred ten dollars ($110.00).
The maximum value that you can reload onto your Arch Card is fifty dollars ($50.00).
The minimum value that you can reload onto your Arch Card is ten dollars ($10.00).
THE SERVICES MAY ONLY BE USED BY INDIVIDUALS AGED THIRTEEN (13) YEARS OR OLDER. IF YOU ARE THIRTEEN (13) YEARS OR OLDER BUT UNDER THE AGE OF EIGHTEEN (18) YEARS, YOU SHOULD REVIEW THIS AGREEMENT WITH YOUR PARENT OR GUARDIAN BEFORE PROCEEDING TO MAKE SURE YOU AND YOUR PARENT OR GUARDIAN UNDERSTAND THEM.
PAYMENT METHODS
Arch Cards may be reloaded on line by using your VISA or MasterCard. Other payment methods may be available at participating restaurants.
Payments will be processed directly by our third party service provider, CTS Holdings, LLC.
PRIVACY STATEMENT
We consider your privacy to be of utmost importance. For information concerning how we collect, use and disclose information concerning Arch Card On-Line Reload, please refer to P2W's Privacy Policy. P2W's Privacy Policy is available on the home page of the Arch Card On Line Reload site.
RESTRICTION OF LIABILITY
NEITHER MCDONALD'S NOR P2W WILL NOT BE LIABLE FOR ANY DAMAGES (INCLUDING ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND) OR INJURY CAUSED BY YOUR USE OF, OR INABILITY TO USE, THE SERVICES, INCLUDING BUT NOT LIMITED TO, ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY OR FAILURE IN OPERATION OF TRANSMISSION, COMPUTER VIRUS, OR LINE FAILURE. THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU TO THE EXTENT THAT APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. MCDONALD'S AND P2W'S TOTAL LIABILITY TO YOU FOR ALL LOSSES, DAMAGES, AND CAUSES OF ACTION (IN CONTRACT, TORT (INCLUDING WITHOUT LIMITATION, NEGLIGENCE), OR OTHERWISE) WILL NOT BE GREATER THAN THE LESSER OF THE AMOUNT YOU PAID TO ACCESS THIS SITE OR TEN DOLLARS ($10.00).
JURISDICTION
The Services are intended for use within the United States. Neither McDonald's nor P2W makes any representation that the Services are appropriate or available for use in locations outside the United States. McDonald's and P2W will have no liability for your use of the Services or provision of data from locations outside the United States.

These Terms and Conditions will be governed and be interpreted pursuant to the laws of the State of Illinois, United States of America, notwithstanding any principles of conflicts of law. If any part of these Terms and Conditions is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. You hereby submit to the jurisdiction of the Federal and/or State courts located in the State of Illinois and the County of Cook or DuPage in connection with all suits, actions, proceedings or other disputes related to these Terms and Conditions and/or your use of the Services. Possible evidence of use of this site for illegal purposes will be provided to law enforcement authorities.
